Nicolae Agachi is a candidate from the second group of non-judicial candidates, nominated by the Parliament for the position of member in the Superior Council of Magistracy (SCM) and was interviewed by the Pre-Vetting Commission in the context of financial and ethical integrity evaluation of the candidates to the SCM.
The public hearing was held in accordance with the provisions of Law no. 26/2022 and the Evaluation Rules of the Commission and touched upon several topics related to the financial integrity of the candidate. The Commission members wanted to clarify the following aspects:
* the origin of funds used by a family member purchasing two real estates used by the candidate and his family;
* the origin of money used for granting two loans to a private company, in 2021;
* under-estimated sale-purchase price of two cars and non-payment of capital increase tax.
🔸Similar to the group of the judicial candidates, non-judges are evaluated by the Pre-Vetting Commission to establish their eligibility for becoming a permanent member of the SCM. Financial and ethical integrity checks cover a period of 15 years.
Following the evaluation procedure, the Commission issues a decision regarding the promotion or failure to promote the evaluation.
