Three SCP candidates failed the resumed evaluation completed by the Pre-Vetting

The Pre-Vetting Commission announces that it has completed the resumed evaluation of three candidates for position of member in the Superior Council of Prosecutors (SCP) and has issued the decisions. The Commission concluded that the SCP candidates, Vitalie CODREANU, Cristina GLADCOV and Anatolie GÎRBU, failed the resumed evaluation.

The Commission’s decisions have been sent to the candidates and to the Superior Council of Prosecutors. The candidates are entitled to appeal the Commission’s decisions to the Supreme Court of Justice within 5 days from their receipt. The decisions will be published on the Commission’s website only with the consent of the candidates.

The Commission undertakes the resumed evaluation of the candidates in the context of a multi-faceted, comprehensive, and objective review, based on information available at the initial evaluation and any information obtained during the resumed evaluation. According to Law No. 180/2023 for the interpretation of certain provisions of Law No. 26/2022 regulating the extraordinary evaluation process, the Commission is not a public authority under the Administrative Code. The resumed evaluation process is guided by this law as this process took place after the entry into force of this law. During the resumed evaluation process, the Commission collects additional information, candidates may present additional information and candidates are entitled to a hearing if they request one. Thus, the three SCP candidates Vitalie CODREANU, Cristina GLADCOV and Anatolie GÎRBU appeared at a public hearing before the Commission (held online) on the 1st and 2nd of November 2023.

Background 

On 8 September 2023, the Commission initiated the resumed the evaluation of 21 candidates for the Superior Council of Magistracy (SCM) and Superior Council of Prosecutors (SCP), following the decisions of the Supreme Court of Justice (SCJ) issued on 1 August 2023. The SCJ annulled 21 Commission’s decisions and ordered the re-evaluation of the candidates. One non-judge candidate for the SCM membership withdrew from the competition during the resumed evaluation process. The Commission is currently undertaking the resumed evaluation regarding 17 candidates for the position of members in the SCM. The Commission is also evaluating one non-prosecutor candidate for the position of member in the SCP. There are also still three pending appeals at the SCJ on Commission’s initial evaluation decisions.
