The Pre-Vetting Commission informs that it has examined the application of the candidate for the position of member of the Superior Council of the Magistracy, Iana Talmaci, currently a judge in the court in Strășeni. Following the deliberations, the members of the Commission decided that the magistrate did not pass the evaluation.
According to Law no. 26/2022 regarding some measures related to the selection of candidates for the position of member in the self-administration bodies of judges and prosecutors, the withdrawal of a candidate from the competition after the institution responsible for organizing the elections or the competition submits the list of candidates to the Commission, is equivalent to not promoting the evaluation, regardless of the reason given by the candidate. At the same time, article 14 paragraph 1 of Law no. 26/2022 provides that the candidate has the right to contest the Commission’s decision, within 5 days of receipt.

Previously, three other judges, candidates for the position of member of the SCM, failed the evaluation. One of them is the magistrate Gheorghe Balan, from the Chișinău Court of Appeal, Buiucani office, who did not submit the 5-year Asset and Interest Declaration, which was established by Commission Decision of 21 July 2022. The withdrawals of candidate Mihail Cojocaru, judge in the Court of Bălți, central office, and candidate Dumitru Pusca, judge in the Court of Appeal, Bălți, were also deemed by the Commission as failure to pass the evaluation, as set out in the Decision of 11 July 2022 and in the Decision of 12 September 2022 respectively.
