Judges Angela Bostan and Iurie Bejenaru accepted the publication of the Pre-Vetting Commission’s decisions on their no-promotion of the evaluation

Judges Angela Bostan, from the Chisinau  Court of Appeal, and Iurie Bejenaru, from the Supreme Court of Justice, candidates for position of member in the SCM, agreed that the reasoned decisions of the Pre-Vetting  Commission regarding  their non-promotion of the integrity evaluation to be made public. The decisions were published on the Commission’s website, in an impersonal form (https://vetting.md/en/decisions/), and will also be published on the website of the Superior Council of Magistracy.  In the case of Judge Angela Bostan, the member of the Commission, Vitale Miron, formulated a separate opinion from the other members, which was annexed to the decision.

Contrary to the two judges, magistrates Anatolie Țurcan, from the Supreme Court of Justice, Vitalie Stratan, from the Chisinau Court, Head Office, and Vladislav Holban, from the Chisinau Court, Centru Office, notified the Pre-Vetting Commission of their refusal to publish the decisions.

Pursuant to art. 14 para. (1) of Law No. 26/2022 regarding some measures related to the selection of candidates for the position of member in the self-administration bodies of judges and prosecutors, the candidate is entitled to appeal this decision in the Supreme Court of Justice, within 5 days from receiving the decision.

Up to this moment, the Pre-Vetting Commission has issued decisions regarding 13 judicial candidates for position of member in the SCM, from the 28 judges who submitted their candidacy in the competition. As a result, 3 magistrates passed the Commission’s evaluation under the aspect of integrity, and 10 were disqualified by not passing the evaluation and can no longer participate in the competition for the position of member of the SCM.
