Press statement regarding unfounded allegations concerning the Chairperson of the Commission

From 2013 to 2018, Herman von Hebel served as Registrar of the International Criminal Court. At the request of the states that are party to the ICC Statute, he undertook in 2014 – 2015 a reorganization of the Registry to address serious deficiencies in its functioning. According to a 2016 external audit report, the reorganization was justified and allowed for an improved functioning of the Registry.
Since 2020, Herman von Hebel serves occasionally as a judge at a Dutch Court of Appeal in criminal cases. Since he started his function as Chair of the Pre-Vetting Commission in April 2022, Herman von Hebel has sat in total for five days at the Court of Appeal.
In 2019 – 2020, Herman von Hebel served as a rule of law expert in Albania, and has not been involved in the vetting of Albanian judges and prosecutors.

โ€ข Herman von Hebel has had the unique opportunity and privilege to function as Registrar in three international criminal tribunals during the years 2006-2018, being appointed by the Secretary-General of the United Nations to be Registrar at the Special Court for Sierra Leone and thereafter at the Special Tribunal for Lebanon.
โ€ข From April 2013 to April 2018, Herman von Hebel served as Registrar of the International Criminal Court (ICC), elected in that position by the judges of the ICC. The Registrar is one of the three โ€œprincipalsโ€ of the ICC, next to the President and the Prosecutor.
โ€ข In December 2013, Herman von Hebel was mandated by the 123 states that are party to the ICC Statute to reorganize the ICC Registry in order to address a number of serious deficiencies in its functioning. This reorganization was done in close consultation with the ICC President and judges, the ICC Prosecutor, the ICC staff union and all ICC states parties.
โ€ข In the context of the reorganization, 120 Registry positions out of a total of 600 were abolished and largely replaced by new positions to ensure improved functioning.
โ€ข Affected staff members were given the option of a separation package or preferential re-recruitment, when found suitable. Less than 10 out of the 120 staff affected challenged decisions before the Administrative Tribunal of the International Labour Organization and were awarded compensation for decisions taken by the ICC.
โ€ข Herman von Hebel was supported in this operation by a team of external tribunal experts and ICC staff. No external expert was later employed in one of the newly created Registry positions.
โ€ข In 2016, the external auditors issued a report about the reorganization of ICC, according to which the reorganization โ€œwas justified in a technical and political reviewโ€ and had โ€œallowed to redefine the values and the principles of the Registry organization, to rationalize its organization (โ€ฆ), to strengthen the field offices and their coordination structure and to review all the positions, which constitutes a positive asset.โ€
โ€ข Although the reorganization was aimed at the improved functioning of the Registry and not at the reduction of costs, the report also concluded that the reorganization led to some limited savings.
โ€ข Throughout the reorganization process, the President, the Prosecutor, and a considerable majority of ICC staff and states parties continued to support the reorganization process.
โ€ข In May 2020, Herman von Hebel was appointed as a part time judge at the Dutch Court of Appeal in Den Bosch in criminal cases. Since September 2020, when he was officially inaugurated, he occasionally sat on cases, whenever other work would allow him to do so.
โ€ข Since he started his function as Chair of the Pre-Vetting Commission in April 2022, Herman von Hebel has sat in total for five days at the Court of Appeal. Herman von Hebel received a daily allowance for each day sitting in court by the Court of Appeal. No other benefits are attached to the position.
โ€ข In 2019 – 2020, Herman von Hebel served as an expert in Albania to assist the Albanian Supreme Court in the development of a strategy to reduce the backlog in cases. He has not been involved and never presented as if he was involved in the vetting of Albanian judges and prosecutors.
โ€ข Herman von Hebel considers it a great privilege and honour to have worked for the promotion and strengthening of the rule of law and justice on an international and national level in a variety of interesting and challenging positions.
โ€ข He remains fully dedicated to the important work of the Pre-Vetting Commission in the Republic of Moldova until its full completion in the coming months.
