{"id":4655,"date":"2025-06-18T15:25:12","date_gmt":"2025-06-18T12:25:12","guid":{"rendered":"https:\/\/vetting.md\/prevetting\/?p=4655"},"modified":"2025-06-18T17:28:02","modified_gmt":"2025-06-18T14:28:02","slug":"comisia-pre-vetting-raspunde-raportului-fes-o-abordare-partinitoare-si-metodologic-defectuoasa","status":"publish","type":"post","link":"https:\/\/vetting.md\/prevetting\/?p=4655&lang=ro","title":{"rendered":"Comisia Pre-Vetting r\u0103spunde raportului FES: \u201eO abordare p\u0103rtinitoare \u0219i metodologic defectuoas\u0103\u201d"},"content":{"rendered":"<p><\/p>\n<p>Comisia independent\u0103 de evaluare a integrit\u0103\u021bii candida\u021bilor pentru func\u021biile din organele de autoadministrare ale judec\u0103torilor \u0219i procurorilor (\u201eComisia Pre-Vetting\u201d) a emis un comentariu public cu privire la raportul \u201eFazele pre-vettingului: fa\u021ba nev\u0103zut\u0103 a reformei justi\u021biei\u201d, publicat de Friedrich-Ebert-Stiftung (FES) \u00een februarie 2025 pe site-ul FES-Moldova.<\/p>\n<p>\u00centr-o scrisoare adresat\u0103 FES, Comisia \u0219i-a exprimat \u201eprofunda \u00eengrijorare fa\u021b\u0103 de con\u021binutul acestui raport, av\u00e2nd \u00een vedere multiplele caren\u021be ale acestuia, inclusiv o metodologie defectuoas\u0103.\u201d Potrivit Comisiei, raportul se bazeaz\u0103 \u00een principal pe opiniile candida\u021bilor care nu au promovat procesul de evaluare \u0219i \u201enu a oferit niciodat\u0103 Comisiei Pre-Vetting oportunitatea de a formula clarific\u0103ri sau de a r\u0103spunde la \u00eentreb\u0103ri\u201d, ceea ce contravine standardelor interna\u021bionale de monitorizare, precum cele aplicate de OSCE\/ODIHR.<\/p>\n<p>Comisia a subliniat, de asemenea, c\u0103 raportul omite deciziile Cur\u021bii Supreme de Justi\u021bie (CSJ) care au confirmat evalu\u0103rile Comisiei \u0219i nu acord\u0103 aten\u021bie deciziilor privind evalu\u0103rile reluate, emise \u00een urma hot\u0103r\u00e2rilor CSJ. La data de 31 ianuarie 2025, \u201eComisia Pre-Vetting emisese 21 de decizii privind evalu\u0103ri reluate, dintre care 18 au fost atacate la CSJ. CSJ a men\u021binut 12 dintre cele 18 decizii atacate \u0219i a dispus o reevaluare.\u201d<\/p>\n<p>Raportul a acuzat, de asemenea, utilizarea necorespunz\u0103toare a informa\u021biilor ob\u021binute de la Centrul Na\u021bional Anticorup\u021bie (CNA) \u0219i Serviciul de Informa\u021bii \u0219i Securitate (SIS). Comisia a respins ferm aceste acuza\u021bii, men\u021bion\u00e2nd c\u0103 \u201etoate aceste solicit\u0103ri au fost legale, propor\u021bionale \u0219i pe deplin conforme cu criteriile de evaluare \u0219i mandatul Comisiei, \u00een temeiul Legii nr. 26\/2022\u201d, \u0219i a subliniat c\u0103 \u201eComisia Pre-Vetting nu a respins niciun candidat exclusiv pe baza informa\u021biilor furnizate de SIS sau CNA.\u201d<\/p>\n<p>Comisia a criticat, totodat\u0103, aplicarea eronat\u0103 a principiului prezum\u021biei de nevinov\u0103\u021bie \u00een raport, explic\u00e2nd c\u0103 acest principiu se aplic\u0103 strict procedurilor penale \u0219i \u201enu este aplicabil\u201d \u00een cadrul procesului\u00a0 de pre-vetting. Referin\u021bele repetate la acest principiu \u00een raport \u201ereflect\u0103 o ne\u00een\u021belegere fundamental\u0103 a naturii \u0219i a sferei de aplicare a garan\u021biilor constitu\u021bionale.\u201d<\/p>\n<p>\u00cen plus, Comisia a exprimat \u00eengrijor\u0103ri privind un poten\u021bial conflict de interese, men\u021bion\u00e2nd c\u0103 autoarea principal\u0103 a raportului, prezentat\u0103 ca expert independent, este \u201eo avocat\u0103 \u00een exerci\u021biu \u00een Republica Moldova, care a reprezentat una dintre judec\u0103toarele CSJ, Mariana Ursachi (Pitic)\u201d, care a e\u0219uat \u00een procesul de vetting \u0219i a f\u0103cut parte din completul CSJ care a anulat mai multe decizii ale Comisiei \u00een anul 2023.<\/p>\n<p>Comisia Pre-Vetting recunoa\u0219te valoarea monitoriz\u0103rii \u0219i raport\u0103rii profesionale \u0219i impar\u021biale cu privire la activitatea sa. Comisia regret\u0103 c\u0103 \u201eautorii raportului FES nu au utilizat o metodologie solid\u0103 \u0219i credibil\u0103 pentru a oferi cititorilor un raport util despre procesul de pre-vetting \u00een Republica Moldova. \u00cen schimb, raportul FES a ales s\u0103 ignore complet deciziile CSJ privind evalu\u0103rile reluate \u0219i deciziile CSJ care au confirmat evalu\u0103rile ini\u021biale ale Comisiei Pre-Vetting, baz\u00e2ndu-se \u00een principal pe opiniile candida\u021bilor care nu au promovat evaluarea \u0219i pe relat\u0103ri anecdotice, f\u0103r\u0103 a le verifica temeinicia sau credibilitatea, precum \u0219i pe articole de pres\u0103 \u0219i emisiuni televizate,\u201d a declarat Comisia \u00een concluzie.<\/p>\n<p>Comisia a \u00eendemnat FES s\u0103 publice integral r\u0103spunsul s\u0103u \u201epentru a permite cititorilor s\u0103 evalueze \u00een mod echitabil observa\u021biile \u0219i concluziile raportului FES\u201d.
